玉山金融控股股份有限公司（以下稱玉山金控）暨所屬各子公司（以下合稱玉山金控及各子公司）係依照「金融控股公司法」、「金融控股公司子公司間共同行銷管理辦法」、「個人資料保護法」及其他相關法令規定，蒐集、處理及利用您的顧客資料，謹聲明交互運用您顧客資料的各子公司對於顧客資料之蒐集、處理及利用均採行嚴密之保密措施，並承諾依據下列聲明內容履行顧客資料保密措施：
E.SUN Financial Holding Company, Ltd. (hereinafter referred to as “E.SUN FHC”) and its subsidiaries (hereinafter collectively referred to as “E.SUN FHC and its subsidiaries”) collect, process, and use your customer data in accordance with the Financial Holding Company Act, the Regulations Governing Joint Marketing by Financial Holding Companies and Their Subsidiaries, the Personal Data Protection Act, and other applicable laws and regulations.
E.SUN FHC and its subsidiaries hereby declare that, with respect to the joint utilization of your customer data, E.SUN FHC and its subsidiaries involved adopt stringent confidentiality measures in the collection, processing, and use of such data, and undertake to comply with the customer data confidentiality measures set forth below.
玉山金控及各子公司取得您的顧客資料，係因服務提供、交易往來、行銷活動中，依相關法令、經顧客同意或於顧客簽署之各類契約文書中明文約定而取得，其中亦包括已公開之資訊、經政府機關揭露或第三人有權提供之合法資料中獲得。
E.SUN FHC and its subsidiaries obtain your customer data in the course of providing services, conducting transactions, or carrying out marketing activities, in accordance with applicable laws and regulations, with your consent, or as expressly stipulated in agreements or contractual documents executed by the customer.
Such customer data may also be obtained from publicly available information, disclosures made by government authorities, or information lawfully provided by authorized third parties.
玉山金控及各子公司將您的顧客資料嚴密地保存在玉山金控及相應之子公司資料庫中，必要時依法委託具有高度安全性、穩定性且管理嚴格的資訊公司儲存及保管您的顧客資料，任何人必須在資料授權管理之規範內，方能取得或使用您的顧客資料；未符合授權規範管理範圍內之任何人或單位，均不能以任何方法通過控管系統而取得或使用您的顧客資料。
E.SUN FHC and its subsidiaries shall securely store your customer data in the databases of E.SUN FHC and the respective subsidiaries. Where necessary and in compliance with applicable laws and regulations, your customer data may be entrusted to qualified information service providers with robust security, stability, and stringent management controls for storage and safekeeping.
Access to and use of your customer data shall be strictly subject to data authorization management controls, and may only be carried out by duly authorized personnel within the scope of such authorization.
Any person or entity outside the scope of such authorization shall not be permitted to access or use your customer data through the control systems.
玉山金控及各子公司以SSL（Secure Sockets Layer）機制進行資料傳輸的加密，並且加裝防火牆防止不法入侵，以避免您的顧客資料遭到非法存取。另應用4至16不定位數密碼及亂碼化方式儲存密碼，以確保您的密碼不會遭到竊取；玉山金控及各子公司皆採用最佳的科技技術來保障您的顧客資料安全。
E.SUN FHC and its subsidiaries adopt Secure Sockets Layer (SSL) mechanisms to encrypt data transmissions and deploy firewalls to prevent unauthorized intrusion, thereby preventing your customer data from being accessed unlawfully.
In addition, passwords consisting of 4 to 16 characters are stored using encryption and obfuscation techniques to prevent unauthorized access to your passwords or accessed by unauthorized parties.
E.SUN FHC and its subsidiaries adopt appropriate technological measures to safeguard the security of your customer data.
玉山金控及各子公司會將您的資料進行分類，其中包括基本資料、往來交易及其他相關資料。資料分類標準如下，但玉山金控及各子公司得依業務特性，增刪資料之分類與內容：
E.SUN FHC and its subsidiaries shall classify your customer data into categories, including basic information, transaction records, and other relevant data.
The criteria for such classification are as follows; provided, however, that E.SUN FHC and its subsidiaries may, subject to their respective business needs, add, delete, or modify the categories and contents of customer data.
包括姓名、出生年月日、身分證統一編號、電話、地址及電子郵件信箱等資料。
Basic information: Includes the customer's name, date of birth, national identification number, contact number, residential address, and e-mail address etc.
1.帳務資料：
包括帳戶號碼或類似功能號碼、信用卡卡號、存款帳號、交易帳戶號碼、存借款及其他往來交易資料、財務情況等資料。
Account information: Includes account number or other numbers of similar purpose, credit card numbers, deposit account numbers, transaction account numbers, records of deposit, loan, and other transaction details, your financial summary etc.
2.信用資料：
包括退票紀錄、註銷紀錄、拒絕往來紀錄及業務經營狀況等資料。
Credit information: Includes returned check records, annulment records, blacklisting records, and performance of your business.
3.投資資料：
包括投資或出售投資之標的、金額及時間等資料。
Investment information: Includes the assets you have invested or sold, and the amount and timing of your transactions.
4.保險資料：
包括投保保險種類、年期、保額、繳費方式、理賠狀況及拒保紀錄等相關資料。
Insurance information: Includes the type of policies you have insured, the tenor, the sum insured, payment method, claims history, and whether your insurance requests have been previously rejected.
為了提供您更完整、更多元且更具優惠之金融理財商品及服務，玉山金控各子公司間基於行銷之目的而從事共同業務推廣行為時，於符合法令、或與您簽訂契約或經您書面同意後，方對您的顧客資料進行交互運用與揭露，玉山金控及各子公司並承諾您的顧客資料將受到良好之保護與管理。
For the purpose of providing you with more comprehensive, diversified, and more favorable financial products and services, E.SUN FHC and its subsidiaries may engage in joint business promotion activities for marketing purposes. Under such circumstances, your customer data may be shared and disclosed among E.SUN FHC and its subsidiaries only in accordance with applicable laws and regulations, or where agreed with you in contractual documents or with your written consent.
E.SUN FHC and its subsidiaries further undertake that your customer data shall be subject to proper protection and management at all times.
在符合法令或與您簽訂契約或經您書面同意時，玉山金控及各子公司與第三人間，得揭露、轉介與交互運用您的顧客資料。惟為符合法令規定或配合政府機關之調查，有義務於法令要求範圍內將您的顧客資料揭露予主管機關、稅捐稽徵機關、法院、司法機關、及其他依法有調查權之機關。
Subject to compliance with applicable laws and regulations, or where agreed with you in contractual documents or with your written consent, E.SUN FHC and its subsidiaries may disclose, transfer, or jointly use your customer data with third parties.
Notwithstanding the foregoing, where required by applicable laws and regulations or for the purpose of cooperating with investigations conducted by government authorities, E.SUN FHC and its subsidiaries shall disclose your customer data to competent authorities, tax collection authorities, courts, judicial authorities, and other authorities with statutory investigative powers, to the extent required by applicable laws and regulations.

如果您的顧客資料有變更，可通知玉山金控各子公司分支單位服務中心，經確認後更正您的相關資料，使玉山金控及各子公司能持續提供您完整之金融資訊與服務。
If there are any changes to your customer data, you may notify the service centers or branches of E.SUN FHC and its subsidiaries in accordance with the applicable procedures. Upon verification, your customer data will be updated accordingly, enabling E.SUN FHC and its subsidiaries to continue to provide you with comprehensive financial information and services.
您可以隨時通知玉山金控及各子公司停止交互運用您的顧客資料進行共同行銷，玉山金控及各子公司將依您通知之意旨辦理。該通知自送達任一子公司後，將於五個工作日內生效。
You may at any time notify E.SUN FHC and its subsidiaries to cease the joint use of your customer data for joint marketing purposes. E.SUN FHC and its subsidiaries shall process your request in accordance with your instructions.
Such notification shall become effective within five (5) business days upon receipt by any subsidiary.
當您訪問或使用玉山金控及各子公司網站、行動應用程式(APP)時，該網站、APP 會記錄您的訪問或使用足跡，以提供您更佳的個人化服務、方便您參與個人化的互動活動，及玉山金控及各子公司為管理該網站使用情形(包括但不限於分析訪客人數、網站流量、使用者分布、產品/服務關注程度、線上活動行為及使用模式)、提昇網站服務品質、提供符合您需求或興趣偏好之客製化資訊或廣告並追蹤其成效等目的。其中部分資料及訪客個人化設定資料將由玉山金控及各子公司自行或透過合作廠商(如 Google Analytics )運用 cookies 或其他類似技術之工具來記錄、存取及蒐集您的線上行為資料。線上行為資料包括當您訪問玉山金控及各子公司網站、其他網站及社群媒體平台(不論是否與本網站相連結者)所為網路行為而產生之資訊(包括但不限於 IP 位址、Cookie ID 與其內容、唯一識別碼、網域名稱、裝置資訊、使用時間、瀏覽器類型、語言設定、地理位置、作業系統、伺服器紀錄、網頁搜尋/瀏覽/點選紀錄及使用模式與資訊或經合作廠商以其名義取得前開資料分析歸納而成標籤等類似資料)，但均屬於不記名的訪客資料且不涉及個人聯絡方式。 惟提醒您，當您訪問或瀏覽使用其他網站與社群平台時，該網站可能會蒐集您的資料，您將受其他網站各自的隱私權保護政策拘束。如您欲停止使用 cookies 或其他類似技術之工具，您可隨時自行更改瀏覽器、安裝程式或變更裝置之設定。如您選擇拒絕 cookies 或其他類似技術之工具，您將可能無法使用玉山金控及各子公司網站或 APP 部分個人化服務，或是參與部分線上活動。 玉山金控及各子公司絕對不會任意出售、交換、出租或以其他變相之方式，將您的顧客資料揭露予其他團體或個人。惟下列各項情形，且於符合法令規範時，玉山金控及各子公司會將玉山金控及各子公司網站所蒐集之您的顧客資料提供予第三人：經過您的事前同意或授權允許時；司法單位、金融監理或其他主管機關經合法正式的程序要求時；為了提供您服務或優惠權益，需與提供該服務或優惠之第三人共用您的資料時，玉山金控及各子公司會在活動時提供充分說明並告知，您可以自由選擇是否接受這項服務或優惠；其他法令明文規定之情形。
When you visit or use the websites or mobile applications (Apps) of E.SUN FHC and its subsidiaries, such websites and Apps may record and track your usage activities for purposes including providing you with enhanced personalized services, facilitating your participation in customized interactive activities, and enabling E.SUN FHC and its subsidiaries to manage and analyze website usage (including, but not limited to, analysis of visitor volume, website traffic, user distribution, levels of interest in products or services, online behavioral activities, and usage patterns), improving service quality, delivering customized information or advertisements tailored to your preferences or interests, and measuring the effectiveness thereof.
Certain data and user preference settings may be recorded, accessed, and collected by E.SUN FHC and its subsidiaries, either directly or through authorized service providers (such as Google Analytics), using cookies or other similar technologies. Online behavioral data may include, but is not limited to, information generated from your interactions with the websites of E.SUN FHC and its subsidiaries, other websites, or social media platforms (whether linked to these websites or not), including IP addresses, cookie identifiers and their contents, unique identifiers, domain names, device information, time of use, browser type, language settings, geographic location, operating systems, server logs, records of webpage searches, browsing and click activities, usage patterns, and tags or similar data derived from analysis conducted by service providers. All such data is collected on an anonymized basis and does not involve personally identifiable contact information.
Please note that when you visit or use other websites or social media platforms, such platforms may also collect your data, and you will be subject to their respective privacy policies. If you wish to disable cookies or other similar technologies, you may do so at any time by adjusting the settings of your browser, applications, or devices. However, if you choose to reject such technologies, you may be unable to use certain personalized services or to participate in certain online activities.
E.SUN FHC and its subsidiaries shall not sell, exchange, lease, or otherwise disclose your customer data to any third party without proper authorization. However, under the following circumstances and in compliance with applicable laws and regulations, your customer data collected through the websites or Apps may be provided to third parties: (i) with your prior consent or authorization; (ii) upon request by judicial authorities, financial supervisory authorities, or other competent authorities in accordance with lawful procedures; (iii) where necessary to provide you with services or promotional benefits in cooperation with third-party providers, provided that sufficient disclosure will be made and you may freely choose whether to accept such services or benefits; or (iv) as otherwise required by applicable laws and regulations.
這份保密措施的保障聲明，從2002年1月28日開始生效，但為因應社會環境及法令規章的變遷與科技的進步，玉山金控及各子公司基於保護顧客資料為考量，於必要時有權修改這份聲明，並儘速於玉山金控及各子公司相關網頁上更新以告知顧客。玉山金控及各子公司如有新增或異動者，將於玉山金控及各子公司之網站揭露公告之。
This disclaimer shall take effect on January 28, 2002. In response to changes in the social environment, applicable laws and regulations, and technological advancements, E.SUN FHC and its subsidiaries may, for the purpose of protecting customer data, amend this Statement as necessary and will publish and update such amendments on the relevant websites of E.SUN FHC and its subsidiaries in a timely manner to inform customers accordingly.
Any additions to or changes in the subsidiaries of E.SUN FHC shall also be disclosed and announced on the websites of E.SUN FHC and its subsidiaries.
